Call of Duty Championship Weekend Giveaway – Terms & Conditions 

THESE RULES ARE THE STANDARD TERMS AND CONDITIONS APPLICABLE TO THE GIVEAWAY ADMINISTERED BY EXPLORE WATERLOO REGION (THE “SPONSOR”). THE GIVEAWAY IS INTENDED TO BE CONDUCTED IN CANADA ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. ENTRY IN THE GIVEAWAY CONSTITUTES ACCEPTANCE OF THESE GIVEAWAY RULES (THE “TERMS & CONDITIONS”). 

1. Eligibility 

This Giveaway is open to legal residents of Canada who are eighteen (18) years of age or older at the time of entry and have reached the age of majority in their province or territory of residence. Employees, contractors, and representatives of the Sponsor, the City of Kitchener, Toronto Ultra, and their affiliates, subsidiaries, advertising and promotional agencies, and their immediate family members or persons domiciled with any of the above are not eligible to participate. 

2. How to Enter 

No purchase is necessary to enter or win. To participate, eligible individuals must complete the official entry form available at https://explorewaterloo.ca/codl-championship-giveaway/ during the Entry Period, including the correct answer to the required mathematical skill-testing question. The official entry form requires you to: (i) enter the information as indicated on the entry form; and (ii) agree to these Terms & Conditions. 

Limit of one (1) entry per individual. For greater certainty, you can only use one (1) email address to enter the Giveaway. All entries must be complete and are subject to verification by the Sponsor, in its sole discretion. If it is discovered that you have attempted to: (i) submit more than one (1) entry per person/email address during the Entry Period; or (ii) use more than one (1) email address to enter the Giveaway; then (in the sole discretion of the Sponsor) you may be disqualified from the Giveaway and all of your entries may be voided.  Your entry will automatically be rejected if the entry form is not fully completed and submitted during the Entry Period. Entries must be submitted by the entrant themselves; entries submitted through automated methods or third parties will not be accepted. 

3. Entry Period 

The Giveaway opens at 12:01 a.m. Canada Eastern Time on May 23, 2025 and closes at 11:59 p.m. Canada Eastern Time on June 3, 2025 (“Entry Period”). Entries received outside this period will not be considered. 

4. Prize 

There is one (1) prize available to be won, consisting of: 

• Two (2) General Admission Floor Tickets to the Call of Duty League Championship Weekend, valid for all four (4) days of the event (June 26–29, 2025) (the “Event”). One ticket is for the winner, and the other may be used by a guest of the winner’s choosing. The Sponsor reserves the right to substitute tickets for comparable alternatives at its sole discretion. 

• Four (4) nights’ accommodation at The Walper Hotel in Kitchener, Ontario (check-in June 26, 2025; check-out June 30, 2025). Room type will be determined by the hotel at its discretion. the Sponsor reserves the right to substitute accommodations with a hotel of comparable quality within the region, should circumstances require. The accommodation includes only the room rate and standard amenities. The winner will be required to present a valid credit card at check-in, and a security deposit may be pre-authorised in accordance with the hotel’s standard policies. All incidental charges, damages, and other expenses incurred during the stay are the sole responsibility of the winner. 

• One (1) $500 Downtown Kitchener BIA gift card. The Sponsor reserves the right to substitute this gift card with another prize of equivalent value at its discretion. 

The total approximate retail value (“ARV”) of the prize package is $2,237 CAD, exclusive of applicable taxes and levies. Winners shall not be entitled to receive the difference between the actual prize value and the approximate prize value. All prize components must be accepted as awarded and have no cash value. The prize is non-transferable, non-refundable, and not convertible to cash.  No substitutions or alterations by the winner are permitted. The Sponsor will not replace any lost or stolen prizes.  The Sponsor reserves the right, in their sole discretion, to substitute a prize of equal or greater value if a prize (or any portion thereof) cannot be awarded for any reason. The prize will only be awarded to the person whose full name and valid email address appears on the official entry form.   

Any other costs or expenses associated with the prizes not specified herein will be the responsibility of the winner, including without limitation meals, communication charges, room service, gratuities, insurance and medical travel documents. The winner must have no restrictions on their ability to travel or to fully participate in the prize or the prize may be forfeited, in whole or in part and may, at the Sponsor’s sole discretion, be awarded to an alternate entrant. The winner is responsible for obtaining all necessary travel documentation and permissions. The winner must obey all hotel and Event rules and requirements. Failure to follow such hotel and Event rules and requirements, may result in, without limitation, ejection from the Event, non-admission to the hotel, and forfeiture of all or part of the prizes described herein. 

In the case of event tickets, if a performer or player is unable to attend the event or an event is cancelled for any reason whatsoever, the prize and any prize portions shall be deemed fulfilled and such prize or prize portions will not be substituted, except in the sole discretion of the Sponsor. The winner will not be entitled to compensation in lieu thereof. 

In the case of gift cards or gift certificates, the terms by which the gift cards or gift certificates may be redeemed are governed by the applicable retailer or service provider. The Sponsor is not responsible for administering or ensuring compliance with the terms and conditions of the gift cards or gift certificates. 

5. Winner Selection and Notification 

One (1) eligible winner will be selected by random draw from all valid entries received during the Entry Period. The draw will be conducted by the Sponsor between June 4 and June 6, 2025 in Kitchener, Ontario. 

The selected entrant will be notified by email using the contact information provided in their entry. To be confirmed as the winner and to claim the prize, the selected entrant must: 

• Respond to the notification within seventy-two (72) hours of being contacted;  

• Have correctly answered the time-limited mathematical skill-testing question, without assistance of any kind, whether mechanical or otherwise, as part of their entry. The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate or necessary to comply with applicable law.; and 

• Sign and return within seventy-two (72) hours of being contacted the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Terms & Conditions; (ii) acknowledges acceptance of the prize as awarded; (iii) releases the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, advertising and promotional agencies, counsel, marketing partners, and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Giveaway, the selected entrant’s participation therein and/or the awarding and use/misuse of the prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of the selected entrant’s name, address, voice, statements about the Giveaway and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Releasees in any manner whatsoever, including print, broadcast or the internet.

If the Selected Entrant fails to respond within the prescribed period, is found to be ineligible, does not sign the Sponsor’s declaration and release form or did not correctly answer the skill-testing question, then he/she will forfeit the prize and the Sponsor reserves the right, in its sole discretion and subject to time constraints, to select an alternate entrant at random from the remaining eligible entries. The process will continue until a confirmed winner is declared. The Sponsor is not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for the Sponsor’s failure to receive a selected entrant’s response.  

Each entrant shall be eligible to win only one (1) prize. The odds of being selected as a potential winner is dependent upon the number of eligible entries received for the Giveaway during the Entry Period. Any remaining entries will not be carried over for entry in a future Giveaway. 

6. Use of Personal Information 

By entering this Giveaway, participants consent to the collection, disclosure and use of their personal information by the Sponsor for the purposes of administering the Giveaway. All personal information will be handled in accordance with applicable privacy laws and the Sponsor’s Privacy Policy (https://explorewaterloo.ca/privacy-policy/), unless the entrant otherwise agrees. 

7. Indemnification by Entrant 

By entering a Giveaway, each entrant releases and holds the Sponsor and its partners harmless from any and all liability for any injuries, loss or damage of any kind to the entrants or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in the Giveaway, any breach of the Giveaway Terms & Conditions, or in any prize-related activity. Each entrant agrees to fully indemnify the Sponsor and its partners from any and all claims by third parties relating to the Giveaway, without limitation. 

8. Limitation of Liability 

The Releasees assume no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. The Releasees are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the administration of the Giveaway. The Releasees assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Releasees will not be liable for any failure of the Giveaway website during the Giveaway. The Releasees are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. The Releasees are not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Giveaway. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Giveaway, or by the acceptance, possession, use of, or failure to receive any prize. The Releasees assume no responsibility or liability in the event that the Giveaway cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Giveaway or the Giveaway website. 

9. General Conditions 

By participating, entrants agree to be bound by these Terms & Conditions and the decisions of the Sponsor. All entries become the property of the Sponsor. The decisions of the Sponsor with respect to all aspects of this Giveaway are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries and/or entrants. 

All entries are subject to verification.  The Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Giveaway.  Failure to provide such proof in a timely manner may result in disqualification.  The sole determinant of the time for the purposes of a valid entry in this Giveaway will be the Giveaway server machine(s). 

The Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify this Giveaway in any way, without prior notice, in the event of any fraud, error, technical failure, tampering, unauthorized intervention, technical problem, computer virus, or any other factor beyond the Sponsor’s reasonable control that impairs the integrity or proper functioning of the Giveaway. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Giveaway is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right, in its sole discretion, to cancel or suspend this Giveaway, or to amend these Terms & Conditions without prior notice or obligation, for any reason whatsoever including but not limited to, in the event of any accident, printing, administrative, or other error of any kind.   

WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE THE GIVEAWAY WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION. 

The Sponsor is not responsible for technical errors, delays, or failures of any kind, including those that may limit or prevent the ability of an individual to participate in the Giveaway. 

This Giveaway is governed by the laws of the Province of Ontario and the applicable laws of Canada. Any disputes shall be resolved exclusively in the courts of Ontario, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. These Terms & Conditions are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. The invalidity or unenforceability of any provision of these Terms & Conditions shall not affect the validity or enforceability of any other provision. If any provision of these Terms & Conditions is determined to be invalid or otherwise unenforceable, then these Terms & Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. 

This Giveaway is in no way sponsored, endorsed, administered by, or associated with Meta (including Facebook or Instagram), Activision, or any other third-party platforms. Entrants acknowledge that Meta (including Facebook or Instagram), Activision, or any other third-party platforms shall not have liability to them in connection with this Giveaway   

10. Language Discrepancy 

In the event of any discrepancy or inconsistency between these Terms & Conditions and disclosures or other statements contained in any Giveaway-related materials, including, but not limited to: the Giveaway entry form and/or point of sale, television, print or online advertising; these Terms & Conditions shall prevail, govern and control. 

11. Intellectual Property 

All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
